Abstract:

The Regional Administrative Court in Warsaw, in the judgment of September 13, 2019 in the case No. VII SA / Wa 1545/19, dismissed the complaint against the decision of the Commissioner for Patient’s Rights regarding the recognition of the practice as violating the collective rights of patients. This decision was issued in connection with the monitoring of patients of the entity providing health services without their prior consent. This gloss is an analysis of the position adopted by the court and the issue of violation of collective patient rights by the entity providing health services using monitoring for which the patient has not consented.
