Abstract:

This article presents the most relevant issues concerning intellectual property rights in the field of artificial intelligence (AI). The purpose of the article is to explain the concept of AI while maintaining terminological consistency with information sciences, and then to analyze the legal framework governing the principles of using data to build AI, the protection of AI systems as such (with particular emphasis on the protection of computer programs and the possibility of patenting inventions in this field), as well as results generated by such solutions. At the end of the article, for general consideration, the author presents a proposal for the regulation of data “ownership” in the era of the digital economy.  

Artykuł przedstawia najistotniejsze zagadnienia dotyczące praw własności intelektualnej w dziedzinie sztucznej inteligencji (AI). Celem jest wyjaśnienie pojęcia AI z zachowaniem spójności terminologicznej z naukami informatycznymi, a następnie analiza ram prawnych regulujących zasady wykorzystywania danych do budowy AI, ochronę systemów AI jako takich (ze szczególnym uwzględnieniem ochrony programów komputerowych oraz możliwości patentowania wynalazków w tym zakresie), jak również wyników generowanych przez tego rodzaju rozwiązania. Na końcu artykułu autor przedstawia do ogólnego rozważenia propozycję uregulowania „własności” danych w erze gospodarki cyfrowej.
