Abstract:

The article is devoted to a complicated issue of declaration of will in the Civil Code of Ukraine. The declaration of will of the participants in a legal act can be expressed orally and in writing. With a few exceptions established by law, the parties can choose the way in which to declare their will. In some cases the Civil Code of Ukraine allows the participants to choose a form of a legal act, and in other establishes a requirement for a certain form of a legal act. The author discusses and comments on various legal effects of non-compliance with the form of a legal act.
