Abstract:

The author analyzes the issues related to the appeal against decisions issued under art. 598¹⁵ of the Code of Civil Procedure. On the basis of the discussed provision, the court may issue a decision threatening the person, under whose care the child remains, with an order to pay a specified sum of money to the person authorized to contact the child for each violation of an obligation resulting from the decision or settlement. Similarly, the court may issue decision threatening the person authorized to contact the child (or a person forbidden to contact with the child) with on order to pay a sum of money to the person under whose care the child remains for each violation of an obligation resulting from the judgment or settlement. Complaining in this respect is a controversial issue in the doctrine and judicature.
