Abstract:

The subject of this article is the analysis of the possibility of creating a national car insurance fund financed from contributions paid by entities using autonomous vehicles. Simultaneously, the fund would be a form of reimbursement of costs, and people who suffered damage as a result of an incident, in order to obtain compensation for the injury or property damage, could turn directly to the fund. At the same time, the author presents possibilities of holding individual entities liable at civil law for the damage resulting from a car accident caused by an autonomous vehicle.  

Przedmiot niniejszego artykułu stanowi analiza możliwości stworzenia krajowego funduszu ubezpieczeń komunikacyjnych finansowanego ze składek opłacanych przez podmioty korzystające z pojazdów autonomicznych. Fundusz zarazem stanowiłby formę refundacji kosztów, a osoby, które odniosłyby szkody w wyniku zdarzenia, chcąc uzyskać rekompensatę z tytułu powstałych obrażeń ciała lub uszkodzeń mienia, mogłyby zwracać się bezpośrednio do funduszu. Zarazem autor prezentuje możliwości obciążenia poszczególnych podmiotów odpowiedzialnością cywilną za szkodę wynikłą na skutek wypadku samochodowego spowodowanego przez pojazd autonomiczny.
