Abstract:

The competences of the commune authorities in the process of implementing own tasks of a local government unit through the subsidy institution are highly diversified and located on many legal levels of reference, in particular the systemic, financial and material ones. The lack of uniformity of legal solutions in the scope of the broadly understood subsidy system results in difficulties in the analysis of regulations and, consequently, leads to irregularities in the implementation of public tasks through the form of subsidies. The appropriate legal composition of the competences of local government units, taking into account the principle of the uniformity of the legal system and the consistent application of legal statements on the basis of individual matters of standardization, will ensure the effectiveness of tasks implementationand the fulfillment of the purpose for which the legislator introduced subsidies as a special type of legal and financial expenditure.
