Abstract:

The purpose of the article is to determine the relationship between the protection of information concerning employees’ health, resulting from their right to privacy and personal data protection, and the employer’s obligation to ensure safe working conditions. The issue of the conflict between the protection of rights such as privacy and non-discrimination, and ensuring the safety in workplace, has not been the subject of in-depth analysis of a labour law doctrine. The article draws attention to the discrepancies between the scope of information about the employee’s health that the employer may legally obtain, and the employer’s needs for ongoing assessment of the employee’s ability to perform work in conditions that are safe for him/her and other workers.
