Abstract:

The purpose of this article is to bring closer the consequences of the still ongoing liberalisation of personal bankruptcy legislation. The amendment of 30 August 2019 significantly expanded the scope of bankruptcy capacity and consequently made it easier to declare bankruptcy and receive debt relief. The consequences of such a legislative procedure are a significant increase in the number of bankruptcy cases, weakening of the position of creditors towards debtors, and a change in the model of bankruptcy adopted in Poland, from a moderate to a liberal one. However, as the analysis of the adopted changes shows, the procedure will only be even more complicated and prolonged.
