Abstract:

In the article the author discusses the possibility of applying civil procedure rules concerning the prohibition of reformatio in peius in criminal proceedings. Although this topic has not been analysed comprehensively in the legal doctrine, the matter is very important. The article aims at clarifying which set of legal rules — civil or criminal — should be applied in relation to civil suit within a criminal trial. The analysis takes under consideration the law amending the Code of Criminal Procedure and repealing civil action in criminal proceedings. Moreover, the argumentation presented in the paper contributes to the discussion about the validity of the elimination of civil action in criminal trial.
