Abstract:

The paper studies relationships between the prohibition to apply corporal punishment under the Family and Guardianship Code, Article 96¹, and excuse of reproving for educational purposes, this excuse working in criminal law. The analysis is provided of issues connected with the subject matter of this article, results of the prohibition under the Family and Guardianship Code, Article 96¹ on the excuse are described, and conclusions concerning the effectiveness of the prohibition are formulated. Practical significance of the issues tackled in this article results from the common nature of the phenomenon of using various forms of reproving children.
