Abstract:

The aim of this article is to compare historical forms of compensation as a kind of response to the crime and the modern criminal law instruments aimed at compensating the crime victims for their losses. The question appears whether these former and current types of compensation are historically interconnected. A historical analysis leads to the conclusion that compensation in the ancient times and the Middle Ages often was the only response to the crime, which was caused by weakness of public authority, whereas modern compensation originates from the concept of restorative justice and concern about crime victims.
