Abstract:

The article deals with the issue of the course of execution from dematerialized shares, which belong to the common property of the spouses. Both the substantive law and the procedural law were analysed. The remarks made also take into account the issues of the subject of execution, the course of proceedings and the limits set by the binding legal regulations. As a result, the solutions proposed by the legislator were evaluated and at the same time postulates de lege ferenda were identified.
