Abstract:

Separate proceedings in the field of labor law is a proceeding regarding the bankruptcy estate, irrespective of whether the claimed claim is a pecuniary or non-pecuniary claim. The declaration of the employer’s bankruptcy always affects the course of such proceedings. The ongoing proceedings are subject to suspension from office when the employer is declared bankrupt. In this respect, the position of the Supreme Court expressed in the resolution of 5 July 2002, III PZP 5/02 is incorrect. The proceeding in the case of restoration to work is also the proceeding regarding the bankruptcy estate, because the execution of the judgment will be related to the management of the bankrupt company’s employer, which is part of the bankruptcy estate. Depending on the type of claim, proceeding may be taken after the receiver has been established or after the mode of reporting the active debt specified in the bankruptcy law has been exhausted.
