The boundaries of interference of insolvency proceedings in administrative enforcement proceedings

Every debtor has to pay his debts – if he does not, then there are proper legal procedures to enforce him to fulfil his obligations. In Polish law the most important of them are enforcement procedures – both judicial and administrative. Nevertheless, insolvency proceeding is also regarded as such a mechanism. The article constitutes a study of mutual relations between execution proceedings and insolvency proceedings understood broadly as proceedings on declaring insolvency (intended to declare the debtor insolvent) as well as proper insolvency proceedings (proceedings carried out after the declaration of insolvency). The author explains the basis for admissibility of securing the debtor’s assets in the course of proceedings on declaring bankruptcy. The paper aims at considering the possibility of enforcement proceedings (including initiation and prosecution) against the debtor for whom the court pronounces the bankruptcy.
