Abstract:

Issues related to the insolvency of entrepreneurs and natural persons who do not conduct business are regulated primarily in two normative acts ‒ the Restructuring Law and the Bankruptcy Law. These regulations have independent character, they aren’t part of commercial law in the strict sense, but they can be included in commercial law in the broad sense. General principles of restructuring and bankruptcy proceedings, i.e. the main values guiding them, are determined by their subject, purpose and functions. In these proceedings are used principles expressed in international and EU law, constitutional principles, economic values, general principles of civil procedure and the main principles expressed explicitly in the acts regulating these proceedings in question and only relevant to them.
