Abstract:

This article is devoted to the subject of discontinuing executory proceedings ex officio. At the beginning it was indicated what is the executory proceedings and who conduct them and what changes have been introduced in the area of the execution lastly. Next, the presumptions for discontinuing the proceedings by law and discontinuing the proceedings by the court executive officer were described and what are its basics in order to notice that difference between ex officio extinction and the legal extinction. Another issue raised in the article is the discontinuance of executory proceedings’ effects. The major objective of the article is to present and discuss the reasons for discontinuing of executory proceedings ex officio.
