Abstract:

The article presents the duties of the presiding judge connected with preparation of the hearing in the context of recent amendments to the Polish Code of Civil Procedures. They focus primarily on the organization and conduct of a preliminary hearing that is the procedure unknown to civil court proceedings. Attention is drawn to new challenges that the legislator poses to judges as a result of new regulations ordering judges to strive for an amicable settlement of a dispute without a necessity to hold a hearing.
