Abstract:

The scope of this work covers the problem of determining legal nature of business entities. Author’s consideration is based on the international law and the case in ICJ between United Kingdom and Anglo – Iranian Oil Company. This particular case law reveals potential criteria which should be applied during determining the legal nature of an entity. These criteria are further compared to both EU and Polish law. Lastly, the article covers the international law institution of state immunity; similarities between immunity and the way of determining nature of business entities allow to propose new solutions – potentially applicable in the Polish constitutional jurisprudence and practice
