The boundaries of freedom of religion in Poland and France - a comparative study

Abstract:

The paper presents and describes legal solutions of freedom of religion in the legal systems of the Polish Republic and the French Republic. Both – the legislation and selected jurisdiction of constitutional courts – are analyzed comparatively for interpretation and implementation of the principle of freedom of religion, the direct guarantee of freedom of worship resulting from it, as well as ways to determine the limits of this principle towards members of the Catholic Church. Presenting the differences in the way of including, guaranteeing the boundaries, interpretation and implementation of the principle itself serves to show that, within the same doctrine of separation of the church and the state, the realization of freedom of religion, including the determination of its borders, does not follow one strictly defined pattern
