Between ecclesiatical law and ordinary law – comments on the language of acts of law on religion

Abstract:

Normative acts of law on religion regulate state – churches relations. Not only people educated in the field of public law participate in the regulation, but also specialists in church law. The internal law of religious communities is characterized by a different conceptual system and legal principles. The above implies the need to adapt the language of sources of law on religion to the conceptual apparatus of both legal orders, which leads to disputes of interpretation and the creation of unintentional loopholes. In the paper, the author present and discuss examples of disputable disputes arising from various scope of designata of concepts used in normative acts of religious law. In conclusion, systemic solutions were proposed that could contribute to reducing the scale of the discussed problem in the process of creating and applying the law
