Abstract:

The economical changes which took place in the 1980s have had significant influence on competition policy dealing with public services (transport, post services, telecommunication). The EU was forced to restrict application of some competition rules to promote services of general interest. The article focuses on acceptable derogations from competition rules with reference to services on general economic interest. The author deals with legal and economical aspects of the problem. From economical point of view, actions taken by states are necessary to meet economical aims of the EC Treaty. From legal perspective, derogations from competition rules in services conditions controlled and slow but steady process of opening said sectors on competition (for instance post services, energy).
