Abstract:

The subject of this work is the right of the accused to defend in a criminal trial on the background of the provisions of Polish criminal law (k.p.k.) and German criminal law ‒ Strafprozessordnung (StPO). In the further part of the article, the precise interpretation was subject to art. 6 k.p.k., as well as 137-149 StPO. The interpretation of the above regulations has been made by means of an analytical and comparative method based on the views of the Polish as well as German doctrine of criminal law.
