Abstract:

This article focuses on the analysis of the powers of the adjudicating court on the assessment of the existence of conditions for the cancellation of conditional release and statutory limits. Also subjected to analyzes the directions of legislative changes consisting in restricting the discretionary power of the judge in the assessment of the occurrence of conditions for the cancellation of conditional release and the results of the examination of the position of judges in this subject.
