Abstract:

The article regards effects of declaration of bankruptcy on marital property regime of the bankrupt. Upon declaration of bankruptcy of one of the spouses, a separate property regime shall arise between the spouses. If the community property regime existed between the spouses, the community property shall be included in the bankruptcy estate and may not be divided.
