The freedom of assembly is one of the fundamentals of a democratic state under the rule of law. The limitation of one of the most important rights in the European Human Rights Convention, i.e. the freedom of assembly, which is more and more frequently introduced under national regulations, poses a serious threat to the guarantees of the civil rights, and consequently a threat to democracy. One of the largest EU countries, which Italy is, for a few years, under the pretext of protecting the public security and order, has been introducing numerous restrictions and defining the so far open constitutional terms, limiting and narrowing the freedom of the interpretation thereof, and, at the same time, rationing the freedom of speech and assembly.
