Abstract:

The monograph concerns the freedom of assembly which is considered the foundation of democracy. To exercise this right is to freely express one’s opinion, whether it pertains to the functioning of the state, the functioning of any particular community or any other matter. It is not the state but rather an individual who is the beneficiary of the freedom of assembly. Thus, the task is for the state to guarantee to the individuals — even if their opinions are contrary to the majority — the ability to publicly display said opinions. In this collective monograph we present theoretical and practical aspects of excising the freedom of assembly, as well as the evaluation of the effect of the actions taken by the state legislature, consisting of numerous substantial changes of the law — the Act on Assemblies.
