This article contains reflections on the impact of Court’s definition of regulatory acts and its determination of access of natural or legal persons to EU courts on national legal institutions in the light of effective judicial protection. This study depicts key parts of Court’s interpretation and a background of Court’s previous view on requirements for challenging the acts issued by EU institutions, beginning with the Plaumann judgment. The author concludes that the Court’s approach is not conducive to realization of effective judicial protection in both planes of the system of legal remedies and procedures, the one based on the EU courts and the other on national courts.
