The aim is to answer the question: what are the differences and similarities between both legal systems? The study includes: ascertainment of brain death and death based on cardio-respiratory criteria; the procedures related to the consent of being a donor after death, rules of the anonymity of donation and provisions relating to the financial compensation. The article also presents terms and conditions for medical staff and health care units procuring organs from deceased donors.
