Starting point are head rules of law state – authority of nation and its sovereignty. The first chapter of presented thesis concerns the head rules of law state, authority of nation and its sovereignty. The author has tried to prove that core and source of democracy is will of the nation/citizens, so rule of sovereignty is only one legitimation to use to institution of direct democracy. The second chapter which presents the instrument of direct democracy in Austria. These are: Volksabstimmung (nationwide referendum with binding result), Volksbegehren (legislative initiative) and Volksbefragung (nationwide referendum, but with not binding result). The Author has paid particular attention to Volksbefragung. This non-binding referendum on ending conscription was held in January 2013. The motion to end conscription and introduce a professional army was finally rejected. The author has compared Volksbefragung with Polish nationwide referendum. He has wanted/ has attempted to show both differences and similarities between those referendums. The last part of the thesis is a natural consequence of the previously reflected inquiries. It describes i.e. what can be changed in Polish and Austrian institution.
