 abstract={In our article we show how the matter of personal inviolability was developing by the ages basing on case Weeks vs USA from 1914 which give birth to an exclusionary rule in american law. In several cases we show in which circumstances this fundamental rule can be resricted or excluded. We are looking for a common features and differences between polish and american law system in personal innviolability matter, considering the reasons that affect it: in history of these nations, the values which the law base on and people’s mentality.},
