It presents the basic restriction on the freedom to form such criteria: the ban on giving non-price criteria the shape of the subjective nature, and the requirement of a connection with the subject-matter of the procurement. Also the article raised the problem of the possibility of verification of non-price criteria selection made by the contracting entity on the basis of the principles most economically advantageous tender. The article concludes of a unique opportunity to challenge the compliance of non-price criteria for the selection made by the contracting authority, which manifest lack of connection with economic benefits.
