 abstract={Changes of the global balance of power and the emergence of new technologies have made economic rivalry an integral part of political rivalry. The reconstructive use of the existing ideas about the rule of law does not help to preserve economic sovereignty. Certain elements of the approach to legislative policy and the application of law should take into account the instrumental, even unfair, application of the law by some states. The application of the existing law should be optimized in the spirit of pursuing the economic interests of the state. The currently prevailing concepts should also be updated, taking into account new threats to economic sovereignty. This requires a kind of axiological entrepreneurship in creating and applying the law.},
