 abstract={The article addresses the problem of maintaining the principle of equal treatment in the case of entrepreneurs in today’s state interventionism in the economy. The conditions for maintaining the principle of equal treatment have been indicated. It has been pointed out that in the conditions of a democratic state it is extremely difficult to recreate a formula or formulas of justice motivating equal treatment. According to the author, the answer to these difficulties is the institutionalization of the way of deciding what is just and on the basis of which values subjects can be differentiated in the law.},
