Wydział Prawa, Administracji i Ekonomii Uniwersytetu Wrocławskiego}, language={pol}, abstract={The area of renewable energy is developing thanks to public support, which – as an exception to the general principle – is allowed in the renewable energy sector. The grounds for such support result from the treaty provisions and are further developed in the EU secondary law provisions. Pursuant to these provisions, the Member States of the European Union are obliged to grant public aid in a competitive tender procedure. As the EU is systematically increasing environmental targets through the development of renewable electricity, it can be expected that alternative solutions – to public support related to investments in renewable energy sources – will be increasingly chosen (and used) by entrepreneurs. An instrument that is an alternative to public support for investments in renewable energy sources is the Power Purchase Agreement. In the indicated model, the parties concluding the PPA agreement do not make their investments dependent on public support, relying solely on private-law forms of contracting the production and delivery of electricity from renewable sources.
