The aim of the gloss is to discuss the consumer’s right to withdraw from a distance contract on financial services based on Directive 2002/65 / EC of the European Parliament and of the Council of 23 September 2002 on the distance sale of financial services to consumers in the light of the commented judgment. The gloss presents the facts together with the questions referred for a preliminary ruling, the ruling of the Court of Justice, and the applicable German law and practice. The ruling was confronted with the relevant provisions of the Treaty on European Union and the Treaty on the Functioning of the European Union. The judgment was analyzed in the light of the European Union’s ideas, such as contractual stability or maximizing the level of harmonization of the legal orders of the Member States and maximizing the level of consumer protection. The “reasonably prudent” consumer model, invoked by the Court of Justice, was also discussed. The judgment was compared with the line of jurisprudence initiated by it, which consists of judgments of the Court of Justice and Polish courts.
