Since the beginning of the 21st century, as part of the Better Regulation policy, the European Commission has been striving to simplify EU law, consult it better with representatives of the concerned sectors and avoid imposing unnecessary administrative burdens on citizens and entrepreneurs. One of the indicated sources of this type of unjustified restrictions are the actions of the Member States undertaken at the stage of transposing EU directives into national law. The article presents definitions of this problem, called gold-plating, which are used by the EU institutions and the Member States; the development of research on this issue was also discussed. The text analyses the negative effects of overtransposition of EU directives which not only imposes unnecessary burdens and obligations on EU citizens, but may also lead to a destabilisation of EU law and disrupt the proper functioning of the internal market.
