 abstract={The aim of this work is to present unreported doubts related to the content of Article 142, § 3 of the Penal and Fiscal Code, which authorizes the legal representative of the offender aged 17-18 to submit on his or her behalf an application for permission to voluntarily submit to liability, at the same time – as follows from the arguments cited in the text – without limiting the direction of exercising this competence only to act in favour of the offender. This regulation was subject to explicit criticism in the article, both as to its purposefulness, as well as compliance with a number of higher-order norms, indicating its unfair role, especially for juvenile incapacitated offenders, and then specific de lege ferenda postulates were expressed.},
