 abstract={The article discusses the issues related to the definition, general characteristics and the content of the condition referred to in Article 99 of the Real Estate Management Act. These issues are extremely important from the point of view of the practice of applying Art. 99 for both – public administration bodies and property owners (not only shared property but also neighboring ones). For this reason, considering the laconic content of the legal regulation, it is reasonable to refer to the doctrine and achievements of the jurisprudence and consider the interpretation of the indicated provision. It is also important to determine whether the interpretation is well established and whether it can be used to clarify the doubts that arise in the practice of conditional division of real estate.},
