The fundamental regulation of this issue is the Act of 11 April 2003 on shaping the agricultural system in the context of the changes made by the Act of 14 April 2016 on the suspension of the property sale of the Agricultural Property of the State Treasury and the amending of certain acts, and the Act of 26 April 2019 on the amending of Act on shaping the agricultural system. The article presents the basic civil issues contained in the Civil Code, such as the definition of the agricultural property and agricultural holding (farm), property right, perpetual usufruct, lease and autonomous possession. The Author has also introduced cases concerning the exclusion of the provisions of the Act. The following part of the article describes entities entitled to acquire agricultural properties that meet the requirements of all statutory restrictions, and entities entitled to acquire agricultural properties to which no statutory restrictions apply. The Act on shaping the agricultural system in Poland in its current legal status is very restrictive. The legislator has personally and subjectively classified persons who may be buyers of the agricultural property. Protection of the agricultural property against its free market sales raises controversy and uninterrupted discussion.}, title={Act on Shaping the Agricultural System in Poland.
