This article aims to prove the correctness of the change in the position of the judicature allowing for the termination of a conditional sale agreement before submitting a declaration on the exercise of the right of pre-emption. The article also indicates defects in the adopted legal solutions regarding the possibility of terminating a conditional sales contract before submitting a declaration by an authorized entity.
