 abstract={The main purpose of this paper is to analyze the most important issues concerning administrativediscretionary power from the perspective of the constitutional law, administrative law and legal theory. The Author systematically explains all the most important principles of relevant determinantsof a structure of administrative discretionary power, such as the interpretation of legal texts whichenacts authorization of public administrative body to allow activities in administrative procedure. Following above-mentioned problems, the main points of interest for this paper are place and role of the constitution and its axiology, as well as axiology of the administrative law in correctly decoding the full legal norm from the legal text which allows public administrative body to use discretionary power in accordance with the law. Another important aspect of this paper are principles of administrative procedures which are excellent examples of normativization constitutional values. There should be no doubt that these principles shall not be treated as irrelevant in application of the law, and that is what the Author tries to prove.},
