As designers introduce several collections a year, providing effective protection of rights is extremely difficult. Simultaneously, it is crucial in view of the constantly expanding global market for counterfeit goods. The purpose of the study was to ascertain whether the currently binding law regulations with reference to fashion designs are effective in the context of fashion design. Different IP rights were subjected to comparative analysis, taking into account the characteristics of the fashion industry. Judgements of Polish, American and Italian courts as well as the judgements of the Court of Justice of the European Union have been used as the analytical research.
