In Polish law the most important of them are enforcement procedures – both judicial and administrative. Nevertheless, insolvency proceeding is also regarded as such a mechanism. The article constitutes a study of mutual relations between execution proceedings and insolvency proceedings understood broadly as proceedings on declaring insolvency (intended to declare the debtor insolvent) as well as proper insolvency proceedings (proceedings carried out after the declaration of insolvency). The author explains the basis for admissibility of securing the debtor’s assets in the course of proceedings on declaring bankruptcy.
