 abstract={The aim of this article is to present the institution of securing of the evidences and of the report regarding the actual state of affairs as well as their comparison. Securing of the evidences is the institution of evidence proceedings and is a competence of court, however, the report regarding the actual state of affairs is non-executive action made by the executive officer. Even though both institutions have many similarities, the differences still exist. For instance, both can have effect on evidence proceedings before initiation. Yet, they differ in the scope of subjects which can initiate proceedings, fees, organisation of the conduct, control. Furthermore, shape of the report regarding the actual state of affairs changed with the beginning of 2019 with the new Act on Court Executive Officers. Inter alia new act introduces definition of the report with new rules that have not been earlier legally regulated. It is true that securing of the evidences has not changed over the last few years, even with there being many revisions of civil proceedings. Nevertheless, it still remains present in the subject’s literature.},
