 abstract={This study analyzed an issue with evidence contracts in polish economic and arbitral proceedings. It was shown, that legal notions such as: “procedural contracts” and “evidence contracts” are well understood. Subsequently, art. 4589 Polish Code of Civil Procedure has been analyzed and discussed the current functioning of the evidence contract in arbitration proceedings. The institution of evidence contracts was compared on the basis of proceedings, indicating similarities and differences. The considerations made in this publication ultimately allowed us to determine a statement of presented novum.},
