The author, using the historical-legal and formal-dogmatic method, analyzes both art. 21 Makarewicz’s Code (introduced by ordinance of the President of the Republic of 11 July 1932), as well as art. 22 Andrejev Code (Act of 19 April 1969 – Penal Code) and art. 25 of the currently applicable Penal Code (Act of 6 June 1997 – Penal Code).
