By using this method, Islamic jurists were able to eliminate discrepancies from the texts of the two main sources of Muslim law, i.e. the Quranand Sunna. Supporters of the theory of naskh trace it to the Quran (Q. 2:106). Conversely, the opponents – who are in the minority – argue that naskh does not have any basis in the Quran. Muslim scholars believe that understanding naskh is a necessary requirement for the correct application of divine laws, and one of the most important preliminary conditions for the analysis of the Quran’s content. In accordance with this conception, sura revealed later erases any contradictory contents revealed earlier. Although at first glance the method of eliminating discrepancies in Muslim law appears to resemble the Roman conflict of laws rule, lex posterior derogat legi priori, it is a quite unclear and very complicated principle. It is therefore often used for ideological purposes.}, title={Naskh - metoda usuwania sprzeczności w prawie islamu}, type={tekst}, keywords={naskh, szariat, Koran, sunna, sprzeczność w prawie islamu, prawo islamskie}, }
