 abstract={The issues presented in the article revolve around the premise for the award of the nursing care benefit indicated in the title. Recognizing the multifaceted nature of the title premise, the author of the text explains how it is understood and presents its significance from the point of view of the legal possibilities of granting the benefit. In this context, the author also discusses the premise of not taking up employment or other gainful work as a parallel premise indicated by the legislature. An analysis of the relationship between the two premises proves that, despite the primary importance of the premise of not taking up employment or other gainful work, the premise of giving up employment may also be relevant in assessing the legitimacy of the application for a nursing care benefit. In formulating this thesis, the author relies on an analysis of the current judicial decisions issued by administrative courts in cases involving nursing care benefits. The author also draws on the body of legal literature on the subject.},
