In Polish criminal law, such behaviour is a offence against property — fraud, qualified under Article 286 §1 of the Penal Code. In its basic form, it is punishable by imprisonment from 6 months to 8 years. The penalty is more severe if the perpetrator’s act consists of two or more acts carried out with a premeditated intention, or if it results in an unfavourable disposition of property by the Social Insurance Institution in an amount exceeding PLN 200,000. The study provides a dogmatic and legal analysis of the legal elements of the prohibited act, the threat of punishment and the characteristics of criminal proceedings in such cases.
