Particularly emphasized is the ability of the party which did not take part in first-instance proceedings to verify the decision in administrative and administrative court proceedings in case every party which took part in administrative proceedings waived their right to appeal. The analysis was conducted for: second-instance proceedings, resumption of proceedings and proceedings before the administrative court initiated by a complaint against the decision. The author presents jurisprudence as well, which has developed since 2017 regarding the article’s subject to prove lack of consistent interpretation of administrative courts about it.
